1Introduction & Agreement

Welcome to NextyHost ("we", "us", "our", "NextyHost"). These Terms of Service govern your access to and use of our website, client account, control panel and all hosting services, including but not limited to game servers, VPS hosting, web hosting and bot hosting.

By creating an account, placing an order, purchasing a service, or otherwise using our services, you agree to be bound by these Terms, our Privacy Policy and our Refund Policy.

If you do not agree with any part of these Terms, please do not use our services.

These Terms form a legally binding agreement between you and NextyHost — A Product of Devu SofTec and IT Pvt Ltd.

2Definitions

3Eligibility & Your Account

By using our services you confirm that:

• You are aged 6 years or above. Users under the age of majority must have the permission and supervision of a parent or legal guardian.
• The information you provide during registration and purchase is accurate and complete, including your name, email, phone number and billing address.

Account rules:

• One account per user. Each person or business should maintain a single account. Multiple accounts created to abuse offers or avoid billing are not allowed.
• Keep your credentials secure. You are responsible for all activity under your account. Never share your password or login details with anyone.
• Keep your details up to date. You must maintain accurate contact and billing information so we can reach you about your services.

If we detect a security issue, suspicious login or unauthorised access, we may temporarily suspend your account to protect your data, and will notify you.

4Acceptable Use Policy

You agree to use our services legally and responsibly. The following are prohibited:

• Using services for any illegal or harmful activity, including fraud, scams, spam, malware distribution or phishing.
• Launching or facilitating DDoS attacks, hacking attempts or any unauthorised access to other systems.
• Hosting or distributing pirated or copyrighted content without authorisation.
• Abusing server resources (CPU, RAM, disk or bandwidth) in ways that degrade the service for other customers.
• Attempting to interfere with, disrupt or bypass the security of NextyHost infrastructure.

You are responsible for the behaviour of everyone using your server, including players, moderators and admins.

5Prohibited Content & Activities

In addition to Section 4, the following content and activities are strictly prohibited on any NextyHost service:

• Illegal content or content promoting illegal activity in any jurisdiction.
• Child sexual abuse material or content exploiting minors in any way.
• Malware, ransomware, viruses, botnets or any malicious software.
• Tools designed for hacking, cracking, phishing or credential theft.
• Content that defames, harasses or threatens other people.
• Spam, phishing and scam content.
• Mining cryptocurrency on shared plans without written permission.

Hosting prohibited content may result in immediate suspension or termination without a refund.

6Services, Delivery & Resource Use

We provide hosting services as described on our website and order pages. Key points:

• Delivery: Most services are set up automatically within seconds to minutes of payment. Complex setups may take longer.
• Resources: Your plan includes specific CPU, RAM, disk and bandwidth limits. Continued use far beyond your plan's limits may result in throttling or a request to upgrade.
• Fair use: You must not use the service in a way that harms other customers or the network as a whole.
• Add-ons: Extra resources (RAM, slots, IPs, DDoS protection) can be added from your account page.

We may make reasonable changes to our infrastructure, panels or networks to improve service quality, and will notify you where significant.

7Uptime Guarantee

NextyHost provides a 99.9% network and server uptime guarantee on all hosting plans, measured on a monthly basis.

• The guarantee excludes downtime caused by planned maintenance, emergency network maintenance, DDoS attacks targeting your server, or issues caused by the customer (including custom configurations).
• We monitor our network around the clock to keep services online.
• If you believe you experienced downtime beyond these exclusions, contact support with details and we will investigate.

No service can promise 100% uptime, but 99.9% means your server should stay online almost all the time. We work hard to keep it that way.

8Billing, Payments & Renewals

Payment terms:

• Payments are processed through Razorpay and CashFree, supporting UPI, cards and other available methods.
• All charges must be paid in full at the time of order. Services are activated only after successful payment.
• Invoices and GST-compliant bills are available in your account.
• Services renew automatically unless you cancel renewal from your account page before the renewal date.
• It is your responsibility to keep a valid payment method and sufficient balance for renewals.

If a renewal payment fails, your service may be suspended, and data may be removed if the account remains unpaid for an extended period.

9Price Changes

We may change prices for any of our services from time to time. When we do:

• We will provide at least 7 days notice before the price change takes effect.
• Notice will be given through the contact details we hold for you and/or a notice on our website.
• Price changes apply to new orders and renewals taking place after the change date.
• Existing paid periods continue at the previously agreed price until they end.

If you do not wish to continue at a new price, you can cancel auto-renewal before your next billing date.

10Ownership of Content

You retain full ownership of all content you store on our servers, including game worlds, configuration files, plugins, websites, bots and any other material.

• NextyHost provides the infrastructure to run your content — we do not claim ownership of your content.
• You are responsible for your content and for ensuring you have the rights to host it.
• We will not access, monitor or use your content except where necessary to provide support, comply with the law, or investigate a violation of these Terms.

11Backups & Data Responsibility

You are responsible for backing up your own data.

• NextyHost provides reliable infrastructure but does not guarantee the availability of backups.
• Hardware can fail, and unforeseen incidents can occur. We strongly recommend you keep your own regular backups of important content.
• Where backup tools are provided on your plan, you should still maintain your own copies of critical data.

Always keep an off-server copy of anything you cannot afford to lose. Data loss due to hardware failure is not the responsibility of NextyHost beyond our reasonable technical efforts.

12Cancellation & Termination

You can cancel a service at any time from your account page. Cancellation stops future renewals, and the service remains active until the end of the already-paid period.

NextyHost may suspend or terminate a service or account if:

• You violate these Terms (see Section 13).
• You fail to pay for a service or renewal.
• Your conduct threatens the security, stability or reputation of our network.
• We are required to do so by law.

Upon termination, your services and access may be removed. Refunds after termination are governed by our Refund Policy.

13Violations & Enforcement

When a violation of these Terms is detected, our process is:

1. Warning: For minor or first-time issues, we will warn you and ask you to fix the problem.
2. Suspension: If the issue is not resolved, or for more serious violations, the affected service may be temporarily suspended until the issue is fixed.
3. Termination: Serious, repeated or deliberate violations may result in account termination without a refund.

We will make reasonable efforts to contact you before taking action, except where the violation is severe, illegal or harmful to our network or other users — in which case immediate action may be required.

Using NextyHost services to attack others, host illegal content, or harm our network may lead to immediate termination.

14Refund Policy

Refunds are handled under our separate Refund Policy.

• Refunds are available within 7 days of purchase only for genuine server issues.
• Refunds are issued as wallet credit with no deductions.
• Add-ons, setup fees and renewals are non-refundable.

Violation of these Terms is not grounds for a refund.

15Privacy

Your privacy matters to us. How we collect, use and protect your personal data is described in our Privacy Policy.

By using our services, you agree to the collection and use of your data as described in the Privacy Policy. We never sell your data and we do not send marketing emails.

16Liability & Disclaimer

Our services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the maximum extent permitted by law:

• NextyHost's total liability for any claim arising out of or relating to the services is limited to the amount you actually paid for the affected service in the billing period in which the claim arose.
• NextyHost is not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.
• We are not liable for downtime or data loss caused by DDoS attacks, force majeure, customer configuration, or events outside our reasonable control.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

17Indemnification

You agree to indemnify and hold harmless NextyHost, its parent company Devu SofTec and IT Pvt Ltd, and their officers, employees, agents and affiliates from any claims, losses, damages, liabilities or expenses (including reasonable legal fees) arising out of:

• Your use of the services.
• Your content hosted on our servers.
• Your violation of these Terms.
• Your violation of any rights of a third party, including intellectual property rights.

18Force Majeure

NextyHost shall not be liable for any failure or delay in performing its obligations due to events outside its reasonable control, including but not limited to natural disasters, pandemics, power failures, network outages, strikes, war, terrorism, government action or failure of third-party services.

In such events, we will make reasonable efforts to restore services as soon as possible.

19Governing Law

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts at Agra, Uttar Pradesh, India.

If you are located outside India, these Terms do not limit any mandatory rights you have under the consumer protection laws of your own country.

20Changes to These Terms

We may update these Terms from time to time. When we do:

• We will update the "Last updated" date at the top of this page.
• We will post the updated Terms on this page.
• For significant changes, we will notify you through the contact details we hold or by a prominent notice on our website.

Your continued use of our services after changes take effect means you accept the updated Terms.

21Severability & Entire Agreement

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be deemed severable and will not affect the validity or enforceability of the remaining provisions.

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and NextyHost regarding the services and supersede any prior agreements.

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
